Terms of Service

These terms are the agreement between you and Kohort Software Limited for your use of Wakeboarding Gizmo, whether you play in a web browser or through the mobile app. By playing, you agree to them. If you do not agree, please do not use the game.
Who we are
Wakeboarding Gizmo is operated by Kohort Software Limited, a company registered in England and Wales, at 71-75 Shelton Street, London, England, WC2H 9JQ. You can reach us at support@kohort.io.
Playing without an account
You do not need an account to play. As a guest, your high score, career stats, landed tricks and recent runs are stored only on your own device. Clearing your browser or app data, or switching device, will lose that progress. We cannot recover guest progress.
Accounts
Creating an account is optional and saves your progress across devices. Accounts use an email address and password. You must give an email address you control, keep your password confidential, and you are responsible for activity carried out through your account. You must be at least 13 years old to create an account.
You choose a rider name, which is shown publicly on leaderboards. Do not use a name that is offensive, impersonates someone else, or infringes anyone's rights. We may reset a rider name that breaks this rule.
Fair play and leaderboards
Scores and progression are validated on our servers. You agree not to modify the game client, automate play, intercept or forge score submissions, or otherwise submit scores that were not achieved by playing normally. Implausible scores may be rejected at the point of submission, and we may remove scores, reset progression, or close an account that manipulates leaderboards.
Acceptable use
You agree not to:
- use the game unlawfully, or to harass, abuse or impersonate anyone
- attempt to access accounts, data or systems you are not entitled to, or probe, scan or overload our infrastructure
- copy, resell, or commercially exploit the game or its assets, or reverse engineer it beyond what applicable law permits
- submit automated or bulk requests to our APIs outside normal gameplay
In-game progression and virtual items
XP, levels, boosters, boards, boats, venues and avatar options are part of the game and are licensed to you for personal, non-commercial use inside it. They have no monetary value, are not your property, cannot be exchanged for money, and cannot be transferred to anyone else. We may adjust unlock requirements, balance or availability as the game evolves. The game does not currently offer purchases of any kind; if that changes, we will update these terms first.
Our content and yours
The game, including its code, artwork, models, sounds and the Wakeboarding Gizmo name, is owned by Kohort Software Limited or its licensors. We grant you a personal, revocable, non-exclusive licence to play it. The only content you provide is your rider name; by choosing one you allow us to display it on leaderboards inside the game.
Availability and changes
We aim to keep the game available but we do not guarantee it will be uninterrupted or error free. We may change, suspend or discontinue features, run maintenance, or update the game at any time. We may update these terms; if a change is significant we will update the date above and highlight it in the game. Continuing to play after a change means you accept the updated terms.
Ending these terms
You can stop playing at any time, and you can permanently delete your account and all of its data from the in-game settings screen (⚙️ Settings → Delete account) or at /delete-account. We may suspend or close an account that seriously or repeatedly breaks these terms, normally with notice unless the breach makes that inappropriate.
Liability
The game is provided for entertainment on an "as is" basis. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law. Subject to that, we are not liable for lost progress, lost scores, or indirect or consequential loss, and our total liability to you in connection with the game is limited to £100.
If you are a consumer, you keep all rights given to you by consumer law, and nothing here affects them.
Privacy
Our Privacy Policy explains what data we collect, why, how long we keep it and how to have it deleted. It forms part of your agreement with us.
Apple App Store
These terms are the licence agreement for the app, and where you download it from Apple's App Store the following also applies.
- This agreement is between you and Kohort Software Limited only, and not with Apple. Apple is not a party to it. We, not Apple, are solely responsible for the app and its content.
- Your licence to use the app is a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules in Apple's Media Services Terms and Conditions.
- Apple has no obligation whatsoever to furnish any maintenance or support services in respect of the app.
- Apple is not responsible for any warranty, express or implied. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (the app is free of charge, so no refund arises); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever in respect of the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are our responsibility.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection, privacy or similar legislation, and claims that the app infringes a third party's intellectual property rights. Apple is not responsible for the investigation, defence, settlement or discharge of any such claim.
- You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.

Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the UK or in the EU, you may also bring proceedings in your local courts and keep the protection of your local mandatory consumer laws.
